In 1994 / 1995 - Royce Mathew filmed and published worldwide a derivative work of his original supernatural pirate story. The same key sequences of Royce Mathew’s supernatural pirate movie, the core story with his fictional inventions, structural blueprints and certain dialogue which were created solely by and appear in Royce Mathew’s 1994 short condensed supernatural pirate movie that was published on CD-ROM in 1995 appear in Disney’s Pirates of the Caribbean: The Curse of the Black Pearl movie and was credited to Ted Elliott and Terry Rossio.

My published 1994 short condensed (low budget) supernatural pirate movie (sold in stores & shown at the 1995 industry E-3 trade show Los Angeles, California) features the Black Pearl pirate ship; a gold medallion on a gold chain with mystic properties - able to "summon/call" especially near the ocean; pirates who don't want anything to do with the plunder/return a treasure because they are cursed; pirates are not being able to enjoy the pleasures of life, like crying, enjoyment of eating and having everlasting thirst. The effects of the curse the pirates endure is revealed by moonlight, revealing decaying flesh skeletons. My story also features five main characters: the eleven year old protagonist who takes the gold in the opening scene & the hold out of the gold medallion by the gold chain / drop it or not scene; the eccentric pirate; the blacksmith; the evil pirate captain who is cursed; the apple/hunger scene between the protagonist and the evil pirate captain involving the gold medallion on the gold chain; and the one eye comic relief pirate. In the opening scene, the young protagonist takes a piece of gold from the shipwreck victim, thus becomes a thief, and sets the story in motion. The one eye pirate then comes after the gold piece. Number of times "to the Black Pearl" is said in Royce Mathew's 1994 supernatural pirate movie - Twice. The number of times "to the Black Pearl" is said in Disney's 2003 supernatural pirate movie - Twice. There is much, much more and none of this was ever originally planned for, designed for or ever found in Disney’s Pirates of the Caribbean ride attractions. (Yet all of these sequences, as well as Universal’s Swashbuckler “pirate hanging sequence” and Warner Bros. The Crimson Pirate “walking underwater under the overturned rowboat sequence”, appear in Disney’s Pirates of the Caribbean: The Curse of the Black Pearl 2003 movie and was credited to Ted Elliott and Terry Rossio.)

A key original line of dialogue I wrote “see what I’ve become” - is said by the evil pirate captain at a pivotal moment, regarding the moonlight, as found in my original supernatural pirate script as well as in my published 1994 CD-ROM that contains a short condensed copy of my supernatural pirate work. I flagged this key sentence in my original 2005 Federal Court filing, pinpointing the importance of it. Then two years later, it is proven that this is the exact same sentence said by the evil pirate captain at the same pivotal moment in Ted Elliott and Terry Rossio’s work for Disney’s supernatural pirate movie. Even Gore Verbinski works with this sequence “see what they’ve become” when the script was being drafted.

It is proven that it was from this key sentence “see what they’ve become” that the new line of dialogue “the moonlight shows us for what we are” is pulled from. In comparison my original line is “let the light adjust your eyes to see what I’ve become”.

The facts substantiate that it was Ted Elliott and Terry Rossio who exploited my work for the sequences. Everything that is key to my claims was credited to Ted Elliott and Terry Rossio. None of this is in Disney’s Pirates of the Caribbean ride attraction. It is also all of the “TELLS” as written and filmed by Royce Mathew, the “BLANK” on one side as exactly found in the Ted Elliott and Terry Rossio drafts. Some of the absolute provable items in my 1994 published CD-ROM and the work credited to Ted Elliott and Terry Rossio early draft include the following:

It is because of the “moonlight element, the gold medallion able to summon, and the unique curse” is what makes the story unique and thus union credit is given to Ted Elliott and Terry Rossio. Yet all that is of my work, as even published in 1994, (see photo and 1994 transcript comparisons, and my original 2005 lawsuit filing). None of this is in Disney’s Pirates of the Caribbean ride attraction. yet Disney has resorted to concocting facts, lies and the rewriting of history with which to officially declare that they had the materials of an unique supernatural story including “cursed pirates” who turn into “living skeletons” in moonlight that preexisted my 1994 published supernatural pirate story. They have even resorted with the changing their Pirates of the Caribbean ride attraction. (Since my claims, Disney states that their Wicked Wench pirate ship was set on fire, sunk, raised and renamed to the Black Pearl).

Yet, Ted Elliott and Terry Rossio who had never went to Disney company archives for research, together with Marty Sklar, who had never met Ted Elliott or Terry Rossio, have boldly claimed in published and sworn testimony that Pirates of the Caribbean has a narrative and that Pirates of the Caribbean has a story about pirates who stole a treasure that they didn’t know was cursed and because of that, the pirates are cursed, having become living skeletons in the caverns-grotto. Meanwhile having been supervised, instructed and assisted by Marty Sklar, Jason Surrell deliberately infused concocted facts and lies throughout Disney’s official Pirates of the Caribbean book with which to support Ted Elliott and Terry Rossio’s fraudulently bold claims.

In 2007, after having assisted, supervised and signed off on Jason Surrell’s Pirates of the Caribbean book, Marty Sklar while under oath, who confirms that he never met Ted Elliott and Terry Rossio, supports and defends Ted Elliott and Terry Rossio and their bold claims. Then in 2008, Marty Sklar signs off on yet another official Disney book which deceitfully concocts that Marc Davis felt that Pirates of the Caribbean ride attraction owed much of its success to its reliance on strong story and characterization.


I, Royce Mathew, an independent artist, am the sole owner of all of my original work, including my supernatural pirate story, screenplays, movie and derivative works. This includes the Black Pearl pirate ship and characters. No one, including Disney, has any authorization nor permission or contract to use, exploit, augment, copy or make derivative works from any of my copyrighted protected works. A short condensed version of my supernatural pirate movie was published in 1994/1995.

I originally filed Pro-Se in 2005, nearly 400 pages, which included detailing access, dialogue and other parts of my unique supernatural pirate story. My case against the Walt Disney Company & Jerry Bruckheimer Films/Inc. etc... was professionally re-filed in Federal Court - Los Angeles California, July 2006. All Defendants including Disney, Jerry Bruckheimer Films/Inc., Ted Elliott and Terry Rossio have all been served. They are all being represented by the same team of lawyers supervised by Sandy Litvack (Mr. Litvack is the same lawyer/person as connected to Michael Eisner as featured in the book “Disney War”).

The Walt Disney Company did not want the court to grant me, along with all of the facts and evidence, a day before a jury. The Walt Disney Company refused to make any offer to purchase my work. The Walt Disney Company has made various false claims against me. The following excerpts are from my 2007 correspondences sent directly to the Walt Disney Company (including Bob Iger & Steve Jobs) which I personally alerted them of some of their putrid and corrupt practices with which to threaten me and have the court wrongly hit me with enormous sanctions, fees and expenses.

“Based on facts and the evidence, Ted Elliott, Terry Rossio along with Jason Surrell, (Wendy Leftkon, Jody Revenson supervising him) concocted facts, rewriting the history of it’s Pirates of the Caribbean ride attraction, then published it, in order to lie and fraudulently claim to the judge, court and their own defense attorneys, this includes you Mr. (Sandy) Litvack, that they had the materials of an unique supernatural story including “cursed pirates” who turn into “living skeletons” that preexisted my 1994 published supernatural pirate story. In turn, Disney attorneys have taken those concocted facts and lies, packaged them as truth, and have set a hostile legal course which to wrongly discredit me, state my claims have no merit and ultimately financially destroy me in one way or another. Mr. Litvack, the truth is, the skeletons in Disney’s Pirates of the Caribbean ride attraction are the remains of dead pirates.

Disney “First Set of Requests of Admissions”. Item number 258 states: Admit Disney’s Pirates of the Caribbean ride attraction contains “skeletal pirates”. But in truth it contains the “skeletal remains” of pirates who died. (I can prove that.)

Disney “First Set of Requests of Admissions” Item number 257 states: Admit Disney’s Pirates of the Caribbean ride attraction contains “cursed pirates”. However, that is just one of several lies concocted by the Defendants as published by Disney in a book entitled “Pirates of the Caribbean: From the Magic Kingdom to the Movies” written by Disney employee Jason Surrell. For in truth Disney’s Pirates of the Caribbean ride attraction contains the skeletal remains of pirates who died, after they plundered the treasure, and it was the pirates themselves who cursed the treasure, as a warning to those entering their final resting home not to touch their treasure. Want some proof, Imagineer’s X. Atencio work, including the full audio (as even released by Disney on CD) proves this. Furthermore, Imagineers Bruce Gordon, Bob Baranick, and even Tony Baxter confirm this in Disney’s own publications.

Added to this, the original Jason Surrell and Wendy Lefkon /Jody Revenson computers/files/drives surrounding these fraudulent and concocted passages that appear in the Pirates of the Caribbean book which are being used to claim that Disney had the materials of an unique supernatural story that preexisted my 1994 published supernatural pirate story, have “vanished” and the other computer “fried” during the same week. Go ahead, ask Jason, Wendy and Jody.

Mr. Litvack, going by their concocted facts and lies, and being a professional attorney, you believed them, then you are being duped, first by Ted Elliott and Terry Rossio and those who are working to protect them. Are you aware that Terry Rossio stated his key computer containing Pirates of the Caribbean work was “supposedly” stolen, and he didn’t file a police report.

Having fully documented and stored it, especially involving three key pages within Jason Surrell’s Pirates of the Caribbean book published in 2005 and again in 2006, and what Ted Elliott published, I am willing to pinpoint and detail for you (or the judge) the exact proof of the concocted facts and deliberately rewritten history. Under the circumstances, I am showing respect, and believe that you didn’t know. I am showing respect as I stress that you have been duped (by Ted Elliott / Terry Rossio / Jason Surrell), who presented concocted facts and lies to you, and in turn, which you are using in your war against me. I believe Jason Surrell was following orders and that someone instructed Marty Sklar to sign off on Jason Surrell’s book.”

Some more facts as originally filed in Federal Court or in correspondence sent to the Walt Disney Company

As documented, Pirates of the Caribbean credited writers Ted Elliott and Terry Rossio have a published history working together assisting in the manufacturing of screenplays for Disney which were especially copied, exploited and augmented from previously published materials, which includes the movies “Aladdin” and “The Puppet Masters”. Ted Elliott and Terry Rossio’s other credits outside of Disney include assisting in the manufacturing of movies which were also based on previous published materials, which includes “Shrek” and the character Zorro.

In self published testimony as well as during an interview promoting Pirates of the Caribbean, credited writer Terry Rossio candidly spoke of his personal affliction, “writer’s block”, which he suffers from. As documented, Terry Rossio gave published testimony admitting that he is “jealous” and “somewhat resentful” of imaginative writers because he is in a constant state of having “writer’s block”, which is a mental state of the inability to write, especially creatively. As documented, Terry Rossio suffers from “writer’s block” especially before and during the manufacturing of the Pirates of the Caribbean movie.

Terry Rossio, who gave published testimony admitting that he permanently suffers from “writer’s block”, has a website with his writing partner Ted Elliott, where for years before, during and after the manufacturing of the Pirates of the Caribbean movie, they had been baiting and encouraging the public and aspiring writers to submit their creative “great ideas” materials to them, and including for a period of time directly to a Disney address after they left DreamWorks. At the very least Ted Elliott and Terry Rossio had also used a DreamWorks address: 1000 Flower Street Glendale, CA 91201-3007 before posting the Disney address of: 500 S. Buena Vista Street Animation 1D-2 Burbank, California 91521. In 2004 after I confronted Disney of the serious matter at hand, the Disney address was quickly pulled off, yet Terry Rossio replaced it his own personal home address on Mulholland Drive to keep accepting those submissions. It wasn’t until I personally notified them of my claims that suddenly they stopped taking submissions.

Ted Elliott and Terry Rossio had been represented by the William Morris agency, and are represented by the Creative Artists agency. These are the same two talent agencies which I had been conducting professional business with regarding the manufacturing of movies and interactive products, including the agencies handling, trading, reviewing and storing my creative materials. The William Morris Agency and Creative Artists Agency are close business associates of Disney.

Before computers having CD-ROM, in 1991 Royce Mathew created the original and unique inter-active card game -"Framed", ("director's chair" - printed on box) which was published in 1992. Royce Mathew’s “Framed” product was handled, reviewed and stored by Creative Artists agency and the William Morris agency, and was also pitched to Disney. "Framed" (sold in stores) deals with the manufacturing of movies at a studio, featuring a supernatural suggested melodrama noir story featuring a murder mystery, a cake and the theft of woman's jewels including a large diamond.

The writing team Ted Elliott and Terry Rossio (both leave Disney to go work at DreamWorks), and (Disney's) Roger Holzberg, are credited on the 1996 inter-active CD-ROM entitled: "Director's Chair" game which deals with the manufacturing of movies at a studio, featuring a supernatural suggested melodrama noir story featuring a murder mystery, a cake and the theft of woman's jewels including a large diamond.

There is my 1987/1991 copyrighted character of “Lobster Man”. Yes, I designed a character that is part human with a giant claw and a spiny leg years before Ted Elliott and Terry Rossio’s Davey Jones character, which is part human male with a giant claw and a spiny leg. Other original characters include humans who meld with sea life.

As with my original supernatural pirate story, the inter-active products of my creation, were part of my original creative materials, which were all handled, shown, presented, traded, stored, discussed and reviewed with Disney, the William Morris agency and the Creative Artists agency. It was with “Framed”, I had also creatively pitched to Disney, demonstrating how I could possibly incorporate certain films of Disney’s library into my unique interactive product, thus changing the default / original movie within this product, while keeping intact my structural blueprint design. Likewise, my short supernatural pirate movie was incorporated into a CD-ROM interactive product which was published in 1995. It was with my many talents, creative materials and inventiveness that the Creative Artists agency, the William Morris agency and Disney had expressed keen interest with. Because of Michael D. Eisner, it was during the same time period that CEO Michael Ovitz left his Creative Artists Agency to become president of the Walt Disney Company, including heading up Disney’s newly formed “interactive” division.

As documented, even though Ted Elliott and Terry Rossio gave published testimony of the benefits of obtaining copyright protection, especially before and during the manufacturing of the Pirates of the Caribbean movie, Terry Rossio warns the public and writers that “your” valuable creative materials “ideas” will be stolen, exploited and controlled by various unscrupulous film makers, executives and companies in the entertainment industry.

As published, prior to working together on the Pirates of the Caribbean movie, Gore Verbinski, Ted Elliott and Terry Rossio all worked for DreamWorks. As promoted, credited director Gore Verbinski’s previous movie prior to directing the Pirates of the Caribbean movie, was copied, exploited and augmented from a previously published movie. Gore Verbinski directed the 2002 movie entitled “The Ring”, which was copied, patterned, exploited and augmented after the Japanese 1998 movie entitled “Ringu”.

In 2004, I clearly identified that Michael Eisner was part of this matter, yet the Walt Disney Company simply ignored it. Yet it was proven in that this was true and indeed part of the story which follows through with Marty Sklar, Eric Jacobson and Brock Thoman, as I previously identified, including with having original files with Brock Thoman’s name and his Disney 1993 phone number. Yes, Disney finally produced the 1992/1993 Michael Eisner memo with my name on it that is part of my claim. Yet Disney states that isn’t significant, and they went from saying they don’t know me to saying that they don’t remember me.

There is much, much more and Disney has formally known my about claims since April 2004.

Shareholder issues archive: I wonder if Michael Eisner or at the very least his legacy is still running the Walt Disney company, for Roy E. Disney sued the Walt Disney Company calling their so-called CEO selection process of Bob Iger “a sham”. In November 2006, Disney made public it’s required 10-K disclosure. It listed and detailed several lawsuits against/involving the Disney company such as Winnie the Pooh. However the Pirates of the Caribbean lawsuit “Royce Mathew vs. Disney” was nowhere to be found in Disney’s 10-K. About ten of Disney’s companies have been professionally served of this lawsuit in September 2006, yet Disney chose not to disclose the details surrounding this lawsuit in their required 2005-2006 fiscal year 10-K disclosure ending September 30, 2006 that is filed with the United States Securities Exchange Commission and is signed off by Bob Iger and Thomas Staggs dated November 22, 2006. Then on January 18, 2007, Disney released it’s 2006 annual report which celebrates the great profits and financial milestones of the Pirates of the Caribbean film franchise. Disney stated that it looks forward to the release of the third Pirates of the Caribbean movie in May 2007 and to continue on with this highly profitable “year round franchise”. On page two, they even show a photo of Bob Iger smiling on the set of Pirates of the Caribbean. However, as with their 10-K, Disney listed the Winnie the Pooh lawsuit, Disney again did not specifically disclose nor detail the “Royce Mathew vs. Disney” lawsuit in their 2006 annual report.
